European Disability Forum Human Rights Report 2024 on Legal Capacity: Personal Choice and Control
The EDF Human Rights Report 2024 on Legal capacity: Personal choice and control, released on 5 September 2024, is centred on investigating the respect for the right to legal capacity across EU member states. Overall, its findings highlight that no EU country fully protects persons with disabilities from losing their right to make decisions. The authors argue that this enables violence and abuse against persons with disabilities. To rectify this situation, the Report presents a list of promising practices in supported decision-making, the collection of free and informed consent, and voluntary support in mental health care. Then concludes with a set of recommendations to the EU institutions.
